2008 ANNE OF GREEN GABLES ONLINE SHORT FILM FESTIVAL OFFICIAL RULES

1. Eligibility

NO PURCHASE OR ENTRY FEE NECESSARY. VOID WHERE PROHIBITED BY LAW.

This Contest is open to all international filmmakers. Employees of the contest sponsor, Sullivan Entertainment, Inc. (“Sullivan”), and their immediate family members and those with whom they are domiciled are not eligible.

Films may be submitted by individuals or by teams. If a film is submitted by a team, all team members must be identified, must register for the Contest and agree to be bound by these rules, and must execute and deliver the affidavits and releases described below.

2. How to Enter

Enter at www.brightcove.com. Click on the “Submit your video here for a chance to win” button and sign up to brightcove.com to enter your films! There is no limitation on the number of films that may be submitted.

In order to ensure fairness to all the films and filmmakers in the 2008 Anne of Green Gables Online Short Film Festival, the following rules are in effect: Although the festival films can be freely viewed, you must be a registered member of brightcove.com and be subsequently signed in to enter your film.

4. Contest Period

Contest ends October 17th, 2008 at 5:00 p.m. (Eastern Standard Time) (Contest Closing Date). All entries must be received by October 17th, 2008 at 5:00 p.m. (Eastern Standard Time) to be included in the contest.

5. Prize

One (1) GRAND PRIZE: The Grand Prize Winner will have the winning video included on the Anne of Green Gables: A New Beginning DVD as a special bonus feature. Also, the winner will receive a prize pack which includes the complete Sullivan DVD Library Collection*, PLUS bonus Anne merchandise**.

One (1) SECOND PRIZE: The 2nd Prize Winner will receive a DVD prize pack+, PLUS bonus Anne merchandise**.

Three (3) RUNNERS UP PRIZE: 3 lucky runners-up will receive their very own Anne of Green Gables Collector’s Edition Box Set signed by Kevin Sullivan himself.

Grand Prize:

o One (1) advanced copy of the Anne of Green Gables: A New Beginning DVD with winning entry included as a special bonus feature, One (1) complete Sullivan DVD Library Collection* and bonus Anne Merchandise**

Note that all applicable taxes, fees and other expenses are the sole responsibility of the winners.

Prizes must be accepted as awarded and no cash equivalent is available. NO SUBSTITUTION OF PRIZES IS PERMITTED EXCEPT BY SULLIVAN IN ITS SOLE DISCRETION. SULLIVAN RESERVES THE RIGHT TO SUBSTITUTE ANY PRIZE WITH ANOTHER PRIZE OF EQUAL OR GREATER VALUE. PRIZES ARE NON-TRANSFERABLE, NOT REFUNDABLE AND ARE NOT REDEEMABLE FOR CASH OR CREDIT, IN WHOLE OR IN PART.

Prizes are provided to winners “as is” without further warranty of any kind.

6. Winner Selection and Qualification

The winning films will be selected by a jury of individuals designated by Sullivan. All entries are judged based on these 5 areas: Concept Originality (Quality of storyline, and script), Production (Camera work, lighting, and shot composition), Post-Production (Editing, transitions, pacing, continuity, and flow), Image (Focus, colour, and lighting), Sound Quality (Clarity, consistency of audio levels, and lack of noise) and each criteria is to be given equal weight.

On September 25, 2008 at 9:00 a.m. (Eastern Time) in Toronto, Ontario, the official selection jury will announce the winners. Finalists and winners will be notified by phone and/or email and will also be listed on the competition website at www.sullivanmovies.com and www.anneofgreengables.com. The Anne of Green Gables International Short Film Festival will use its best efforts to announce the winners at the designated time, but will not be held liable for any unforeseen delays.

All prizes will be awarded to the first name as it appears on the entry form for a winning film, and division of prizes among co-directors is the responsibility of such individual. Sullivan will use its best efforts to send prizes out in a timely fashion. All federal, provincial/state, and local taxes, and customs fees, when applicable, are the sole responsibility of the winners.

7. Notification

The winners will be notified by email or phone. Each winner will be required to complete and sign an Affidavit of Eligibility and Liability Release and, where legal, a Publicity Release, which must be returned within 48 hours by fax or e-mail after issuance of prize notification or the prize will be forfeited and awarded to an alternate selection.

Return of any prize/prize notification as undeliverable may result in disqualification and selection of an alternate winner

8. General Film & Video (Movie) Rules

All video submissions must adhere to the following rules:

- All videos submitted may not exceed over Five (5) minutes in length with a Maximum size of 100MB. Videos must be a minimum of two (2) minutes in length.

- The Anne of Green Gables Online Short Film Festival is open to all independent filmmakers from around the world regardless of their nationality or origin. Films of any language will be accepted as long as they have English subtitles.

- The winning films will become property of Sullivan with the owner relinquishing all rights, including droit moral, to the film [DN: Ensure that the Affidavit of Eligibility and Liability Release includes assignment of copyright and waiver of moral rights.]. In addition, the Grand Prize winner will not receive any video royalties, residuals or revenue of any kind for use in any media whatsoever or in any territory around the world relating to the inclusion of the winning film or any part of the winning film on Anne of Green Gables: A New Beginning DVD or the distribution and promotion of the DVD in any jurisdiction or any media.

- The films submitted in the Contest may be seen by viewers of all-ages. Sullivan will monitor every video submission to determine whether content is appropriate for The Anne of Green Gables Online Film Festival. Sullivan reserves the right to remove from the online portion of the contest any content it deems at its sole discretion to be inappropriate.

- Winners will be required to sign affidavits confirming that their short films are original and he/she holds all rights (music, actors, locations etc.). Failure to sign and return the forms within the required time period (48 hours) or provision of false information may result in disqualification and an alternate winner may be selected. Affidavits of winners under 18 years of age at time of award must be countersigned by parent or legal guardian. Affidavits are subject to verification by Sullivan and its agents

- Be advised that we can not publish any videos with copyrighted materials on the website or DVD. See “Representations and Warranties” below.

- Sullivan reserves the right at its sole discretion to disqualify any individual that it finds to be tampering with the entry process or the operation of the Contest or Contest Site; to be acting in violation of the Official Rules; or to be acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person.

CAUTION: ANY ATTEMPT BY A CONTESTANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE GAME MAY CONSTITUTE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SULLIVAN RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH CONTESTANT TO THE FULLEST EXTENT PERMITTED BY LAW.

In the event of any claim relating to breach of the Grand Winner’s representations, warranties or covenants, Sullivan reserves the right to not release the film on DVD and/or substitute the film with any other alternate winning selection.

10. Covenants, Representations and Warranties

By entering the Contest, contestants covenant and agree: (i) to release and hold harmless Sullivan from any and all liability for any injuries, loss or damage of any kind arising from or in connection with the Contest, or the use or acceptance of any prize won; (ii) to indemnify and hold harmless Sullivan and it, affiliates, directors, officers, consultants, agents, and employees against and from all claims asserted by third parties, and all related damages, liabilities, costs and expenses, alleging that contestant’s participation in the Contest, including any film submitted, involves obscenity, libel, defamation, slander, or infringes upon any third party’s intellectual property or privacy rights, or arising from a breach of the representation and warranties below; (iii) not knowingly to damage or cause interruption of the Contest or prevent or interfere with others participation in the contest; or (iv) not to otherwise tamper with the entry process or the operation of the Contest.

By entering the Contest, each contestant represents, warrants, covenants and agrees that:

i) the contestant, or the contestants where there is a team, has the sole and exclusive right and title to all rights to the film submitted, including without limitation, copyright and performer’s rights (the “Rights”) absolutely and not jointly with any other person, firm or corporation;

ii) the contestant, or the team if applicable, has the sole and exclusive right to grant the Rights to Sullivan and is free to enter the film in the contest without reference to any other person, firm or corporation;

iii) the contestant, or the team if applicable, has obtained all of the rights, permissions and licenses (including all music licenses, i.e. synchronization and performance) necessary to fully release the film in any media whatsoever or in any territory around the world, including, without limitation, the right to use performers’ names and likenesses.

iv) there are no liens or encumbrances affecting the film submitted and no claim, litigation or any other form of proceeding by or before any court, tribunal or any competent authority of any jurisdiction in the world is pending or threatened against the contestant, or the team if applicable, with respect to the film or the Rights;

v) the film does not contain any material that is obscene, libelous, defamatory or slanderous of any person, firm or corporation;

vi) the film does not infringe the copyright, trademark, literary or intellectual property or the right of privacy of any person, firm or corporation.

11. Limitations of Liability

Sullivan is not responsible for (i) any incorrect or inaccurate information, whether caused by website users or by any of the equipment or programming associated with or utilized in the Contest, or by any technical or human error which may occur in the processing of submissions in the Contest; (ii) any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or authorized access to, or alteration of, entries; or (iii) any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers or providers, computer equipment, software, failure of e-mail or players on account of technical problems or traffic congestion on the Internet or at any website or combination thereof, and expressly disclaims all liability therefor including injury or damage to contestants’ or to any other person's computer related to or resulting from participating or downloading materials in this Contest.

If, for any reason, the Contest is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sullivan which corrupt or affect the administration, security, fairness, integrity or proper conduct of this contest, Sullivan reserves the right at its sole discretion to cancel, terminate, modify or suspend the contest.

IN NO EVENT SHALL SULLIVAN BE RESPONSIBLE HEREUNDER FOR ANY INCIDENTAL, CONSEQUENTIAL, SPECIAL OR INDIRECT DAMAGES EVEN IF IT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

12. Acceptance of Official Rules

By providing information and participating in the Contest, each entrant and his/her parent/legal guardian, if necessary, agrees to and accepts these Official Rules and the decisions of Sullivan and the judging panel, which are final and binding in all matters related to the Contest.

13. Personal Information

Information collected from entrants is subject to the Privacy Policy for Sullivan Entertainment Inc. (http://www.sullivanmovies.com/privacypolicy.html). Entrants have the right to withdraw or correct their personal data. Entrants can make such requests by sending a detailed email message to: contests@sullivan-ent.com that must include all the original sign-up information provided.
